Texas House Bill No. 362

In 2011 the Texas State Legislature enacted Texas House Bill No. 362 into law.This act amended Section 1, Chapter 202 of the Property Code by adding sections 202.010 and 202.011.These amendments target HOA regulation of solar energy devices.The law states that “a property owners’ association may not include or enforce a provision in a dedicatory instrument that prohibits or restricts a property owner from installing a solar energy device” (Texas HB 362, 202.010.b).
